1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with permission of a parent or legal guardian who agrees to be bound by these Terms.

2. Accounts & Security

• To access certain features (e.g., creating articles, submitting poll suggestions, voting where email verification is required), you may need to register an account with accurate information and keep it updated.
• You are responsible for safeguarding your credentials and for all activities under your account. Notify us immediately of any unauthorised use or suspected breach of security.
• We may refuse registration, reclaim usernames, or disable accounts that violate these Terms or our policies.

3. Polls, Voting & Integrity

• We may use cookies, session tokens, device signals, IP checks and/or email verification to help enforce “one person, one vote” where applicable.
• You must not manipulate results (e.g., automated scripts, multiple accounts, vote-buying, coordinated brigading, VPN farms). We may invalidate suspicious votes and restrict or ban offending accounts/devices.
• We may set per-poll rules (eligibility windows, geofencing, ID/email checks) and change or cancel a poll to protect integrity.

4. User Content & License

“User Content” includes text, images, poll ideas/suggestions, comments, or other material you submit or upload.

• You retain ownership of your User Content. By submitting it, you grant TrendsLab a worldwide, non-exclusive, royalty-free license to host, store, cache, reproduce, modify for formatting, publish, display and distribute your Content in connection with operating, promoting and improving the Service. This license ends when you remove your Content from the Service, except for reasonable archival/back-up copies and where retention is required by law or for legitimate business purposes.
• You represent and warrant that you have all rights to grant the above license and that your Content does not infringe others’ rights or violate the law.
• We may moderate, refuse, or remove Content at our discretion (e.g., illegal, infringing, hateful, deceptive, or spam).
• If you believe material on the Service infringes your copyright or other rights, contact us (see Contact) with details so we can review and respond.

5. Acceptable Use

You agree not to:

• Use the Service in a manner that violates any applicable law or regulation.
• Attempt to access accounts without authorisation, probe/scan/penetrate systems, circumvent security or rate limits, or interfere with the Service’s proper working (including scraping without permission).
• Upload or share content that is illegal, defamatory, harassing, hateful, misleading, or otherwise objectionable; or that contains malware or malicious code.
• Manipulate polls or metrics, or engage in spam, promotions, or advertisements without our prior written consent.

6. Intellectual Property

The Service, including text, graphics, logos, and software, is owned by TrendsLab or its licensors and is protected by applicable intellectual property laws. Except as permitted by law or by written permission, you may not copy, modify, distribute, sell, or lease any part of the Service. Open-source components are provided under their respective licenses.

7. Third-Party Services & Links

We may integrate third-party services (e.g., analytics, email delivery, hosting/CDN) and link to third-party sites. We are not responsible for third-party content, policies, or practices. Your use of third-party services is subject to their terms.

8. Privacy

Our handling of personal information is described in our Privacy Policy. By using the Service, you consent to those practices.

9. Suspension & Termination

We may suspend or terminate your access to the Service (and remove Content) at any time if we reasonably believe you violated these Terms, to protect the Service or other users, or for operational/security reasons. Upon termination, provisions that by their nature should survive (e.g., licenses granted, disclaimers, limitations of liability) will continue to apply.

10. Disclaimers

• The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied.
• News, articles, and poll results are for informational purposes only and do not constitute professional advice or an endorsement.
• We do not guarantee accuracy, completeness, or availability; we may suspend, change, or discontinue features at any time.

11. Limitation of Liability

To the maximum extent permitted by law, TrendsLab and its affiliates, directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; or any loss of profits, data, or goodwill arising from or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages. Our aggregate liability for all claims relating to the Service shall not exceed the greater of KES 10,000 or the amount you paid (if any) to use the Service in the 3 months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless TrendsLab and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your Content, or your violation of these Terms or any law.

13. Governing Law & Venue

These Terms are governed by the laws of the Republic of Kenya without regard to its conflict of laws rules. You agree to the exclusive jurisdiction and venue of the courts located in Nairobi, Kenya, for all disputes arising out of or relating to the Service or these Terms.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms here and update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Miscellaneous

• Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
• No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our prior written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
• Entire agreement. These Terms constitute the entire agreement between you and TrendsLab regarding the Service and supersede prior agreements.
